Case of YZ (and A.N.other) 2019 EWCA CRIM 466 judgment handed down on 19 March 2019. Our client sentenced to a term of imprisonment of 6 years after entering guilty pleas for sexual assault of a child and the making and distribution of indecent images.

Historic sexual offences are allegations of sexual offences that are made a long time after the alleged incident. The allegations can relate to a single incident or multiple events. The accused could have been a stranger or known the complainant in a professional or familial capacity (including marital rape which in the past was not considered an offence).

Disclosure Failures in Sexual Offence Cases

At the beginning of this year, the BBC discovered that the Crown Prosecution Service (CPS) had dropped over 900 rape and sexual offences cases in 2016-17 (almost double the figure in 2014-15) because of failures in the disclosure process. The revelation followed the publication of two reports in 2017 (the HMCPSI and HMIC joint inspectorate report on disclosure of unused material, and the Mouncher investigation report) that were scathing of how the police and CPS share information with the defence and handle disclosure.

Michael Barrymore Due Damages for Wrongful Arrest

The sexual assault and death of Stuart Lubbock at Michael Barrymore’s home in 2001 remains unsolved in 2017. Michael Barrymore, having been arrested under suspicion of the rape and murder of Mr Lubbock, is suing the Chief Constable of Essex Police for his arrest in June 2007 claiming that it was unlawful and he was, as a result, falsely imprisoned. Mr Barrymore brought the action under his real name of Michael Ciaran Parker, seeking damages of £2.4 million. The Claimant, Mr Parker, alleges that he suffered damage and “very substantial financial losses” as a result.
