However, although it is possible to disguise information on the darknet, using an encrypted peer-to-peer network or anonymising software, authorities are cracking down on those using it to carry out criminal activity - both intentionally and unintentionally.

Indecent images and the law

The Criminal Justice Act 1988 and the Protection of the Children Act 1978 set out the law on downloading indecent images of children. It is a criminal offence to possess any photograph or pseudo-photograph of a child which is indecent. Possession includes where there is evidence of indecent images on an electronic device, including computers and mobile phones, when the owner has control of the images.

It is also an offence to take, allow to be taken, or to make an indecent photograph or pseudo-photograph of a child. This offence covers the circumstances where an indecent image appears on a screen, even unintentionally. In this situation, it must be shown that the image was unsolicited.

What happens if I am accused of an internet sex offence?

There are many reasons as to why you are being investigated or accused of internet sex offences. Often police will receive a tip from the NCA or the US equivalent. This may have occurred because your IP address has been captured. Alternatively, the police may have been informed by someone close to you, or an alleged victim.

The police may come to your home with a court warrant, or they may come without a warrant in order to seize your devices and other evidence. In some circumstances, they may simply ask to come in to speak to you.

If your devices are seized, you may be invited for a police interview shortly after. You can be interviewed under arrest or voluntarily.

After your interview, you will be released under investigation or on bail while your devices are examined. A forensic examination can take months or even over a year to be completed. I understand how tense this time may be for you, but during this delay, we can take the time to build your case.
